Stephen Dent, prosecuting, told a judge at Bristol Crown Court: ôThe Crown has received additional unused material and we have had additional time to consider our position.

ôThis involved a case of driving across a level crossing. On looking at this matter further itÆs a crossing that has something of a history.

ôOther local people have been spoken to and they will say they have had problems with this crossing.

ôHe is an elderly gentleman. A conviction is not likely.ö

Nothing unusual in this. The Crown Prosecution Service (CPS) will not proceed with a case if they don't think they are going to win. Losing doesn't do their stats any good in the government's eyes

The fact that other users have noted defects in the crossing means that the defending lawyer has a better chance of getting his client off.
