Nothing unusual in this. The Crown Prosecution Service (CPS) will not proceed with a case if they don't think they are going to win. Losing doesn't do their stats any good in the government's eyesarticle wrote: Stephen Dent, prosecuting, told a judge at Bristol Crown Court: ôThe Crown has received additional unused material and we have had additional time to consider our position.
ôThis involved a case of driving across a level crossing. On looking at this matter further itÆs a crossing that has something of a history.
ôOther local people have been spoken to and they will say they have had problems with this crossing.
ôHe is an elderly gentleman. A conviction is not likely.ö
The fact that other users have noted defects in the crossing means that the defending lawyer has a better chance of getting his client off.
